Terms and Conditions-Mothers Day Promotion Gift Card
This document sets out the Terms & Conditions of the Mothers Day Promotion Gift Card (the ‘Gift Card’) provided by Sydney University Sport trading as Sydney Uni Sport & Fitness (SUSF). These Terms & Conditions apply to both the Gift Card purchaser and receiver from the initial purchase date until redemption and the expiry date.
You agree to be bound by these terms and conditions by purchasing, activating, using, or attempting to use a Gift Card or by making a transaction enquiry or exercising any right to redeem value loaded on a Gift Card. By purchasing, activating, using or attempting to use a Gift Card, or by making a transaction enquiry or exercising any right to redeem value loaded on a Gift Card, you warrant to us that you will comply with these terms and conditions and all applicable laws. If you are giving a Gift Card to another person, you should ensure that he or she is aware of the terms and conditions that apply to the Gift Card and the relevant Expiry Date of the Gift Card.

PURCHASE & REDEMPTION
The Gift Card purchaser must choose use from the following three options (the “Promotion Options”) when purchasing the Gift Card:
- Seven group fitness classes; or
- Seven casual gym entries; or
- Fifteen swim sessions; or
The Gift Card purchased must choose from one of the three Promotion Options. This choice is final and cannot be reversed.
Gift Cards can only be redeemed when authorized by an SUSF staff member.
Your use of the Gift Card and Promotion Options at SUSF is subject at all times to the policies (and, where applicable, other terms and conditions) of SUSF regarding the goods and services made available by it.
The Promotion Options are not able to be used by under 18s.
The Promotion Options are only available for one member and can not be shared between individuals.
Receivers of the Gift Card must be new members.
EXPIRY DATE
All Gift Cards and Promotion Options are valid for nine months from the purchase date. Nine months from the date of purchase the Gift Card and the balance of any Promotion Options not used expire and are no longer valid. It is the responsibility of the Gift Card receiver to ensure the Promotion Options are redeemed before the expiry date. SUSF is unable to extend the expiry date.
SECURITY
Both the purchaser and receiver of the Gift Card(s) are responsible and liable for the safety and use of the Card.
SUSF will not be held responsible for lost or stolen Gift Cards. Gift Cards are to be treated like cash; defaced, altered, lost or stolen Cards will not be replaced, refunded or redeemed. SUSF has no obligation to replace or refund value for lost, stolen or damaged Gift Cards except where SUSF has breached any condition or warranty implied under consumer protection legislation that cannot be excluded in these terms and conditions.
SUSF reserves the right to place a stop on a Gift Card if:
(a) you report that your Gift Card has been lost, stolen or damaged; or
(b) SUSF believes (or reasonably suspects) that a purchaser or receives has used (or will use) their Gift Card contrary to these Terms and Conditions.
LIABILITY
Subject at all times to the exceptions in the paragraph below SUSF is not liable to the purchaser or receiver for any loss or damage (whether direct, indirect, consequential or special) either in negligence, other tort, breach of contract, breach of warranty or for any other reason or cause whatsoever, arising out of or in connection with a Gift Card or these Terms and Conditions.
The exclusion of our liability only applies to the extent permitted by law. Where consumer protection legislation implies any condition or warranty that cannot be excluded in these terms and conditions, SUSF limits its liability for breach of any such implied conditions or warranties to re-supply of the services (or costs thereof). Any liability SUSF has will be reduced by the extent (if any) to which the purchaser and/or receiver caused or contributed to the loss or damage. This will apply even after this agreement has ended.
CHANGES TO TERMS AND CONDITIONS
SUSF reserves the right to change any of the terms contained in these Terms and Conditions at any time where the change is required for any reason. We will give you notice by posting the changes on the SUSF website.
PRIVACY
Any personal information a Gift Card purchaser or receiver provides will be collected, stored and used in accordance with SUSF’s Privacy Policy available at www.susf.com.au
